1. Agreement

These Terms & Conditions ("Terms") govern your use of the VKS Media Pro website (vksmediapro.com) and any services provided by VKS Media Pro ("we", "our", "us"). By accessing the website or purchasing our services, you agree to be bound by these Terms.

2. Services

VKS Media Pro offers website design and development services for local businesses. The exact scope of each project is defined in writing (email, WhatsApp or invoice) before work begins. Any work outside of the agreed scope may be quoted as additional work.

3. Quotes & Pricing

All prices are listed in US Dollars (USD) unless otherwise stated. Quotes provided to you are valid for 14 days from the date issued. Prices and packages on this website may change at any time without notice; the price agreed in your invoice or written agreement is the price that applies to your project.

4. Payment Terms

• Advance: 50% of the total project fee is required before we begin work.
• Final Payment: the remaining 50% is due before final files are handed over and the website is deployed.
• Payments are processed through secure third-party providers (such as Stripe). By making a payment, you agree to the terms of the payment provider.
• Late payments may delay project timelines and may attract a reasonable late fee.

5. Project Timeline & Client Responsibilities

Delivery timelines (typically 7–14 days) start from the date we receive (a) the advance payment and (b) all required content from you (text, images, logo, brand details). Delays in providing content, feedback or approvals will extend the timeline accordingly.

6. Revisions

The number of included revision rounds depends on your selected package (Starter: 2 rounds, Business Growth: 3 rounds). Revisions are limited to changes within the agreed scope. Major changes outside the original scope will be quoted separately.

7. Content & Intellectual Property

• You confirm that all content you provide (text, images, logos, etc.) is owned by you or properly licensed for use.
• Once final payment is received, you own the rights to the final website design and the content delivered to you.
• We retain the right to display the work as part of our portfolio unless you request otherwise in writing.

8. Hosting, Domain & Third-Party Services

Hosting and domain registration are usually handled by you directly with your chosen provider (such as Hostinger). VKS Media Pro is not responsible for the performance, downtime or pricing of third-party hosting, domain or other services.

9. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

10. Acceptable Use

You agree not to use our services for any unlawful, fraudulent or harmful purpose, including (but not limited to): hate content, adult content, gambling without proper licensing, infringement of intellectual property, or anything that violates applicable law or payment-processor terms.

11. Limitation of Liability

To the maximum extent permitted by law, VKS Media Pro's total liability for any claim arising out of or relating to our services is limited to the amount you have paid for that specific project. We are not liable for indirect, incidental, consequential or special damages, including loss of profits or business opportunity.

12. Confidentiality

We treat any non-public information shared by you during a project as confidential and will not disclose it to third parties except as required to deliver the project or comply with the law.

13. Termination

Either party may terminate a project by providing written notice. Refunds (if any) will be calculated based on the work already completed, in line with our Refund Policy.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts of Udham Singh Nagar, Uttarakhand, India.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of our website or services after changes means you accept the updated Terms.
